TEMPORARY VISITOR TO LONG TERM RESIDENT

QUESTION:

Greetings Mam’/Sir.

My name is Jessica. I was divorced from Japanese national in the year 2000. My one and only son is already a grown-up man and now living and working in Japan. He was born and raised in Japan. When I live in Japan, I used to extend my visa every three years. My case is sensitive. I drop my wallet in the train that has a drug and when I went to the lost and found section, I admit that it was mine. I also agree to have a urine test which I already know what will happen next. The police let me go home and when I reached home, I talked to my husband and he said that he will help me since the drug is for our use. 3 days later, plain clothes police came to our apartment and picked me up. I was detained in Tokyo and underwent the legal process which after 3 months, the court let me free. I still have my visa this time. But when I went to the immigration after one year to extend my visa, they detained me right away and while I was in the immigration detention center, my husband was caught on drugs and sent to jail. The care of my son went to the parents in law because they are capable of taking care of him. Both me and my husband agreed to file a divorce while I was in the immigration detention and my husband was in jail through a volunteer attorney. I spent more than a year in the detention center until a group of Filipino helped me with my plane ticket. After 20 years, I tried to get a visa, but I was denied. I want to visit my son and also the in-laws since I know where they live and know the address of my son. I want to know why I was denied for a visa. Please advise me.

ANSWER

I read your question.

When I explained my answer to you from a conclusion, the possibility that you can enter Japan is unfortunately zero. It means that your application will not be accepted eternally even if you continue to do it.

According to the Immigration Control and Refugee Recognition Act, you can find out the Article 5 entitled the “Refusal of landing” in which is specified 23 items of reason for landing refusal.

The term of landing refusal differs for every item. It divides four types/kinds, such as 1 year, 5 years, 10 years and permanent. And your case corresponds to the 1st paragraph, No. 5-clause, and the refusal term of it is stipulated as “permanent”.
