Marriage Annulment
QUESTION:
I divorced my ex-Japanese husband and will be remarried with another Japanese in Japan. How can I carry out the marriage annulment procedures in Japan and in the Philippines? – Analyn
ANSWER
I cannot indicate the details from the convenience of column’s space. The flow of a rough procedure, which our office always carries out, is as follows:
In Japan
1) Acquisition of documents (ex-husband’s family register)
2) English translation of documents (ex-husband’s family register)
3) Creation of the documents (the extract of the Civil Code article, translation, etc.) for notarization
4) Notarization by the Notary Public Office
5) Authentication by the Philippine Embassy in Tokyo or Consulate general in Osaka
In the Philippines
1) Filing the petition to a Regional Trial Court
2) Trial in the Court
3) Decision of petition by the Court
4) Correction of your marriage records at LCR
5) Correction of your marriage records at PSA
6) Acquisition of “Advisory on Marriage (singleness)” from PSA
7) Marriage report to the municipal office in Japan
8) Marriage report to the Philippine Embassy or Consulate General
9) Marriage registration at PSA after the Philippine Embassy or Consulate General sent it to PSA
10) Acquisition of family register from the municipal office
11) Acquisition of marriage certificate from the Philippine embassy or Consulate General
