Embryo Cognition

QUESTION

I’m pregnant. The father is a Japanese who is still married. Is it possible to report the child as his child? And is it possible that I give birth in Japan? What are the requirements so that I can give birth there? – Paula

ANSWER

The only way which you can take is to request from him the “Embryo Cognition.” The Cognition is a legal action based on the Civil Code of Japan, and the effect of it is very mighty. Legally speaking, it has found the paternal relation with a Japanese father and your embryo. Simultaneously, the embryo can acquire the Japanese nationality and can get a Japanese passport. Moreover, you can enter a country and reside in Japan as a foreign mother of a child who has the Japanese nationality. Even if he is a married man, if he loves you and you became pregnant as the result of it, he will recognize your embryo. On the other hand, if you became pregnant as a result of carrying out a physical affair as a temporary caprice or a playmate, he will not recognize your embryo.

For your information, it is possible to perform embryo cognition at the Japanese Embassy in the Philippines. So, you don’t have to come to Japan. And the way of it is very easy. If he visits the Japanese Embassy and notifies that “I want to make the embryo cognition”, he will be taught the required procedure and documents.

In addition to this, even if you would give birth in Japan as you may wish, your child does not acquire the Japanese national like the USA. That is even if you give birth in the Philippines or in Japan, the problem which you are holding will not solve unless he “recognizes” your embryo. I hope you understand the regulation. In addition to this, the documents/certificates are required when the cognition will be carried out.

1) Cognition report (2 copies)

2) Family register of father (1 original copy & 1 copy)

3) Birth certificate of mother/Japanese translation (1 original copy & 1 copy)

4) Copy of mother’s passport/Japanese translation (1 original copy & 1 copy)

5) CENOMAR (Certificate of Non-Marriage Record)/Japanese translation (1 original copy & 1 copy)

6) Statement which mother agreed the cognition and sign on it/Japanese translation  (1 original copy & 1 copy)

7) Father’s passport (or driver’s license) (1 original copy)
