Visa Application Denied

Dear Attorney,

I sincerely give my thankfulness to your column in the Philippine Digest. I am one of those who are avid readers and enlightened with your counsel. I would like to ask your counsel too in my personal situation. My name is Silvia, a permanent visa holder since last year (2020). I have two questions that are always bothering my mind and do want to find a solution to them. I have two children, Kenny (26 years old) and Ramon (19 years old). We’ve been staying here in Japan for almost 10 years together with my husband who is a Filipino. I’m Japanese descendent 3rd generation. So, my children belong to the 4th generation. I applied for a Certificate of Eligibility to the Immigration Bureau twice for my children, but it was denied twice unfortunately. For each application, I’ve been waiting for 9 months to come out just to have informed me. But it was denied.

1) My first question is that why is it that took so many months to wait for the result hoping for a positive outcome, but it was denied in the end? Though I received documents from the Immigration, I cannot read and understand Japanese. What is it, and what does it mean? Now, I am planning to apply for a visiting relative’s visa in the Philippines for my children. If ever they will grant my request, I will again apply here in Japan for a “Change of Status” application from the “Visiting relatives visa” to the “Long Term Resident visa”.

2) My last question is that could it be possible? Do they have a chance to be granted? Any help to you sir will be truly appreciated and I will wait for your reply hoping that by this time, my questions will be answered rightfully and I’m hopeful for a solution.

I am appreciating you are always reading my columns on the Philippine Digest. Yes, I received your letter posted on January 5 and January 8. I understand what you are inquiring about and your wish. So, please find my answer and comment on your question as follows. As you see, these contents are not desirable for you.

However, if you consult with me in person showing materials or data which can prove your nature of Japanese descent, the better solution may be found. Although our office is located far away, your present address in Saitama-city, so many clients who live in Saitama-city with the same and different cases as you have already came here to do it. I also hope to solve your problem.
