The Reason of Null of Permanent Residence

QUESTION

I have a permanent residence visa. It became void/null since I did not come back to Japan in a year. Now, I’m holding a visa with a one-year validity period. Can I apply again for a permanent residence visa?

ANSWER

As you quite understand, the Immigration status of “Permanent Resident” is granted to those who have intension to settle in Japan permanently. Therefore, those who have been residing permanently in other countries without residing in Japan are judged to be a “Person who has no intension to settles permanently in Japan,” and his/her permission for permanent residence is to be cancelled in accordance with the Immigration Act.

Then, if you would like to acquire permission for permanent residence again, you must make a new application. It will be determined based on the criteria of the act. Some cases will be granted, and some other cases will be not. For your information, your period of stay must be given the longest one (five years), which is defined in the act when you would make an application. Moreover, it is taken into consideration as negative implications that permission for permanent residence had been cancelled in the past.
