Temporary Visitor to Long Term Resident

Q-4) If the Japanese Embassy in the Philippines will grant a visiting relative’s visa to our children and they will enter into Japan, I will apply for the change of status from “visiting relative’s (=Temporary Visitor) visa” to “Long Term Resident” at the Tokyo Immigration for them. Could it be possible?

A-4) Application for “Temporary Visitor” will be granted only if you can prove your financial guarantee and your two children are judged that there is no possibility of setting to work in Japan.

Afterward, they may be entered into Japan.

However, even if they would apply for change of status to the Immigration, their application, desiring from a “Temporary Visitor” to “Long Term Resident”, would not be granted essentially based on Paragraph-3, Article-20 of the Immigration Control and Refugee Recognition Act. That is, according to Paragraph-3, Article-20 of the Immigration Control and Refugee Recognition Act. It stipulates as follows:

“In the case of an application submitted by a person whose status of residence is Temporary Visitor, permission shall not be granted unless the application is made based on special unavoidable circumstances.”

Then, as you see, when it takes into consideration your child case, the “Special unavoidable circumstances” does not exist at all. In addition to these factor/circumstances, it is also considered that their application for certificate of eligibility was denied in the past, and the authority is always considering that your child case must be based on the application for “Certificate of Eligibility”, but not the application for “Change of Status” when they will enter and reside in Japan.
