Overstay

QUESTION

I am a Nepalese. I came to Japan using visit visa to meet my father but now I am an overstay. How can I stay legally in Japan?

ANSWER

The measure, which those who are now overstay should take is one of the following ways:

1) Departure order. You by yourself may surrender to the Immigration Bureau promptly, and report/notify the fact of overstay. After the investigation by the Immigration Bureau would be carried out, you can go back to your country by the system of the “Departure order,” which is one of the deportation orders.

2) Special Permission to Stay in Japan. In this case, you will be granted the Special Permission to Stay if your case would come under the criteria/requirements. On the other hand, when it does not come under the criteria/requirements, you would be carried out the deportation to your native country. First, after making an appointment (090-1436-4107), you may visit my office and explain your situation precisely showing the data (passport, certificates etc.). Second, I will create all documents, which are required from the Immigration Bureau in order to obtain the “Special Permission to Stay” from the Minister of Justice. Third, you may surrender to the Immigration and submit all required documents, which I created up for you. Fourth, the Immigration officer-in-charge will investigate, inspect and hear everything about your case from you. Fifth, the Minister of Justice will decide whether your case should be granted the “Special Permission to Stay” or not.
