QUESTION:

I divorced my Japanese husband by saiban rikon (judicial divorce) last June 12th, and when I notified my divorce to the immigration, they said that I can stay in Japan for three months only even if I have a six-month visa. In addition to that, my Japanese fiancé and I want to get married. What should I do? Can I marry him before my visa expires? Please help.

ANSWER

Please find my comment in general as follows: On June 1st, 2016, the Civil Code was revised and a woman of second marriage prohibition term was changed from “six months” to “100 days”. Moreover, a woman can carry out the marriage at least less than 100 days if she can submit the doctor’s certificate certified that “she is not having become pregnant on or after the day of divorce” based on the 733 articles of revised Civil Code with the condition that other requisites for marriage are provided.
