Possibility to re-enter Japan after being deported

QUESTION

Can I go back to Japan after being deported last 2008 because of overstaying? My sister wants to invite me again as temporary visitor after 9 years.

– Sheryl

ANSWER

In principle, the period of landing refusal concerning those who were deported by force because of the unlawful stay suspicion is as follows:

  1. The case arrested by the Immigration official/police is “5 years” from the date when he/she was deported.
  2. The case where he/she by himself/herself reported his/her unlawful stay to the Immigration Bureau spontaneously and was disposed by a “Measure of Departure Order” is “1 year”.

Therefore, you will be granted the issuance of the “Temporary Stay” visa since it has already passed over ten years or more. However, if there is other evasion circumstance (Ex: deportation of the unlawful stay was carried out two times or more, deportation by other items was carried out in the past etc.), your application will be denied. Anyway, the contents of the invitation letter is very important.
